Executive Decree n° 98-348 of 17 Rajab 1419 corresponding to 7 November 1998
fixing the application conditions and terms of the Article 143 of the law n° 83-17 of 16 July 1983, modified and complemented, concerning the waters code. (05

Article 1
The present decree aims at fixing the application conditions and terms of the
Article 143 provisions of the law #83 17 of 16 July 1983, countersigned.
Article 2
The agents skilful to search and record offences to the waters code provisions
are appointed by a ministerial decision among
-Hydraulic personnel, i.e.
1. engineers having a minimum of two (2) years experience.
2. senior technicians and specialized technicians having a minimum of three (3)
years experience.
3. assistant techniques, specialized techniques agents and techniques agents
having a minimum of five (5) years experience.
These agents are appointed among the employees holding office at the level of
the central and decentralized administrations in charge of hydraulics.
-Employees of Irrigation Perimeters Exploitation, i.e.
1. engineers having a minimum of two (2) years experience.
2. senior technicians and specialized technicians having a minimum of three (3)
years experience.
3. assistant techniques, specialized techniques agents and techniques agents
having a minimum of five (5) years experience.
Article 3
The typical model of the recorded offence minutes is appended to the present
decree. The minutes are transmitted
-to the competent territory state prosecutor,
-to the wilaya director in charge of hydraulics.
Article 4
The provisions of the countersigned decree # 84 05 of 2 January 1984 are
abrogated.
Article 5
The present decree will be published in the Official Journal of the Democratic
and Popular Republic of Algeria
